Warranty claims in the EU: frequently asked questions

Who is responsible, how long you are covered, and what to ask for.

Should I claim from the seller or the manufacturer?

The seller. Under EU law the shop that sold you the product is responsible for the legal guarantee, even if it tells you to contact the manufacturer. A manufacturer warranty is an extra promise on top and does not replace the seller’s obligation.

How long does the legal guarantee last?

At least two years from delivery in every EU country. Some go further: Spain gives three years, Ireland lets you bring a claim for up to six years, and the Netherlands has no fixed period and looks at how long the product should reasonably last.

Who has to prove the fault was there from the start?

If the fault shows up within the first year (two years in France and Spain), the law presumes it was there at delivery. The seller then has to prove otherwise. After that period you may need evidence, such as a repair shop’s report.

Can I ask for a refund straight away?

Usually not. You first ask for a repair or replacement. A refund or price reduction becomes available if the seller refuses, takes too long, the repair fails, or fixing it is impossible. The letter handles this order for you.

Does a repair extend my guarantee?

Yes, since 31 July 2026. The EU Right to Repair Directive adds 12 months to the legal guarantee when you choose repair over replacement. Enter the repair date under “Details for the letter” and the tool adds the extension.

Does this work for second-hand products?

Yes, if you bought from a business. Some countries let the seller shorten the guarantee on used goods to one year, but only if you agreed to it at purchase. Purchases from private individuals are not covered.

What happens to the details I enter?

They stay in your browser so you can come back to your claim. Nothing is sent to us unless you join the claims agent early access list, and then we only receive your email and the type of claim.

Is this legal advice?

No. The tool applies the general rules for each country to the dates you enter. Contracts, gifts, imports, and business purchases can change the answer. For a large or disputed claim, contact a consumer organisation or a lawyer.

Most claims fail on paperwork, not on the law

HoldMyBill keeps the receipt, the delivery date, and the repair history for everything you own. When something breaks, the proof is already there.
